Can NSWAHA represent me?
Because NSWAHA is not a union, under workplace laws it has very limited ability to represent workers.
NSWAHA cannot perform many of the basic representation functions of a union.
NSWAHA cannot bring proceedings against your employer for a breach of employment, and cannot get a permit to enter your workplace to support you and other members.
Additionally, NSWAHA cannot represent you for:
- Formal unfair dismissal or bullying proceedings or applications
- Federal Court proceedings
Finally, NSWAHA cannot be covered by an Enterprise Agreement.
